How to comply with the smoking ban

Using the current laws and regulations implemented by UK legislation. Every business and organisation to which the smoking ban legislation applies will need to take all 'reasonable precautions' to ensure employees, customers and visitors don't smoke on their premises.

Recommendations are that as a minimum, businesses and organisations should: -

  • Display the required signage in a way that makes staff, customers and visitors aware that they are in a no smoking area and that they have to comply with the law. These signs must be: -
    • At least 230mm x 160mm in size
    • State that you are a no smoking premises and that it is an offence to smoke there or knowingly to permit smoking there.
    • Display the international No Smoking symbol, at least 85mm in diameter.
    • Display the name of the person to whom a complaint should be made by any one observing some one smoking.
  • Remove all ash trays
  • Develop and implement a smoking policy to ensure that infringements are dealt with under agreed procedures.
  • Inform anyone smoking that they are committing an offence and request they extinguish their smoking material immediately or leave. Refuse service to individuals who are smoking against the law.
  • Refuse service to individuals who are smoking against the law.

In cases where physical intimidation or violence is threatened, the assistance of the police should be sought. Managers and other responsible persons should keep a record of any incidents where customers, staff or others have ignored the smoking ban and any outcome that resulted.
